How to Sign a Power of Attorney in New Hampshire

    • 1). Write it down. All powers of attorney in New Hampshire must be in writing. The document must include the name of the principal, the name of the agent, the powers conveyed and the effective date of conveyance.

    • 2). Notarize the POA. If the power of attorney allows the agent to convey real property or interests in real estate, the principal must have the document notarized. Have the document notarized by a New Hampshire licensed public notary.

    • 3). Get two witnesses. If you convey durable power of attorney for health care, you must sign in the presence of two witnesses. These witnesses cannot be the agent nor can they stand to inherit property from the testator either through a will or under the laws of intestate succession.

    • 4). State your intention and sign in the presence of the witnesses. A durable power of attorney for health care is only valid when the principal is of sound mind, free from coercion and expresses his awareness of what the document contains. Make this information clear to the two witnesses and sign the document in their presence.
