What Is a Notice of Settlement Contract?

    • A notice of settlement explains the history of the case and advises the court which parties to the lawsuit are settling their dispute. If one party has agreed to pay another to resolve the lawsuit, the notice of settlement will disclose the sum being paid and explain how payments will be made to the other party. The notice of settlement will also state that the settlement is binding on all of the parties' representatives, successors and heirs.

    Filing

    • A notice of settlement contract is filed with the clerk of the court that has jurisdiction over the legal dispute. The judge assigned to the case will review the terms and conditions of the contract to ensure that it complies with the law and is acceptable to the court.

    Effect

    • After the judge has reviewed and approved the notice of settlement contract, the parties may thereafter request that the lawsuit be dismissed.
