How to File a Trade Name in Arizona
- 1). Research guidelines on how to choose a trade name. Phoenix Public Library has put together a brochure with resources to help individuals check the availability of a proposed business, service name or product before registering a trade name.
- 2). Check for the availability of the trade name to avoid registering a name that's already in use. Trade names can be researched with the Corporation Commission or by calling 602-542-3230. Construction companies need to call 602-542-1525 to check trade name availability and mortgage companies need to call the Department of Banking at 602-255-4421 to check trade name availability.
According to Arizona Revised Statue 44-1460.01(B), the Secretary of State will not file a trade name that is not distinguishable from any other name previously filed or on record, but it also does not guarantee exclusive rights to a name. If you find that your trade name conflicts with or infringes on another business name after filing, you may want to contact a trademark lawyer to settle the dispute or register a new trade name. - 3). Complete an application for registration of your trade name, pay applicable fees and mail it back to the address listed on the application. Fees sent by mail must be paid by check or money order.
